Running a restaurant in California: the insurance side.
State law on serving alcohol, mandatory workers’ comp and county health permits all touch how a California restaurant is insured.
Quick answer: Liability coverage is a lease and permit matter here, not a statewide mandate, while comp kicks in with your first hire. The state’s dram shop law generally shields sellers of alcohol, with an exception for serving an obviously intoxicated minor.
Three California rules restaurant owners run into
A narrow dram shop rule
Business and Professions Code 25602 generally protects sellers from liability for what an intoxicated guest does later. Section 25602.1 makes an exception for serving an obviously intoxicated minor.
Comp for every cook and server
Labor Code 3700 makes workers’ comp mandatory for employers. Kitchen and front-of-house roles are rated on payroll, so how hours get reported moves the premium.
Health permits by county
Retail food facilities need a public health permit from their county. Some permit and outdoor dining programs add their own insurance conditions.
Where California restaurant policies can fall short
| Restaurant exposure | Standard form? | Typical fix |
|---|---|---|
| Liquor claims | Excluded for alcohol sellers | Liquor liability policy or endorsement |
| Earthquake | No | Separate earthquake coverage |
| Delivery accidents | No | Commercial or hired and non-owned auto |
| Spoiled inventory | Sometimes | Spoilage endorsement |
| Wage and hour claims | No | Employment practices liability, with limits |

What California restaurant owners ask us.
Does California have a dram shop law?
California’s rule largely protects sellers. B&P 25602 says furnishing alcohol is not the proximate cause of injuries an intoxicated person causes, and 25602.1 creates an exception for serving an obviously intoxicated minor. Liquor liability coverage still responds to defense costs and other claims.
Do restaurant staff need to be covered by comp?
Yes, once anyone is on payroll. Line cooks, dishwashers, hosts and weekend-only servers all count under state law.
Does a California restaurant need earthquake coverage?
Standard commercial property policies exclude earthquake. Whether separate coverage is worth considering depends on your building, your lease and how long you could stay closed.
Can a food truck use the same policy as a restaurant?
Usually not entirely. A truck generally needs commercial auto for the vehicle, plus liability and equipment coverage, and event organizers may ask for their own certificates.
What do California landlords ask restaurants to carry?
Common leases ask for a set liability limit and additional insured status for the owner. Bars often see a liquor liability requirement written in as well.
